Minutes of the emergency meeting of the Brant Town Board held on Thursday, September 4, 2003 at 5:00 p.m., held at the Brant Town Hall, Brant-N. Collins Rd, Brant, New York.

There were present:

            The meeting was opened with a pledge to the flag led by Supervisor Chiavetta.

            No minutes were read or approved from previous meeting, as this was a special meeting.

There was special mention of the Board approval of waiving the 78-hour notice for   meetings and that there were notices properly posted and new media was contacted.

There is a waiver on file along with the notices of posting.

A motion was made by Councilwoman Rosiek to accept the letter of resignation from Jamie S. Nolan as Town Clerk. Supervisor Sam Chiavetta seconded the motion and a roll call vote was taken.

Supervisor Chiavetta made a Motion to Appoint Thea A. Ells as Interim Town Clerk. Councilman Rubeck seconded the motion and a roll call vote was taken.

Councilman Rubeck made motion to Appoint Gina DeMaria and Tammy Czyz as Deputy Clerks. Councilwoman Bowman seconded motion and a roll call vote was taken.

Motion was made by Councilman Rubeck that Rose DeMaria be brought in as a contractual consultant at the rate of $10.00 per hour. Councilman Rosiek seconded motion.  A roll call vote was taken.

Supervisor Chiavetta asked for confirmation that the Town Clerk would notify the State Comptrollers Office, the Secretary of State of State of New York, and the Board of Elections, and the County Clerks Office of the resignations and appointments. Attorney John Grennell asked to follow up with the appropriate authorities also.

Supervisor Chiavetta read a letter to confirm with Evans National Bank that Thea A. Ells would now be the signer of the Town Clerks accounts. Supervisor Chiavetta asked for a Resolution giving that authority to Thea A. Ells.  Councilman Bowman seconded the resolution. A roll call vote was taken.

Discussion took place concerning Health Insurance coverage for the previous Town Clerk and the Cobra Law.  The board to no action and tabled the matter till the next meeting.  Motion to table by Councilman Bowman.  Seconded by Councilman Rosiek.  All in favor. Motion carried.

Motion to Adjourn by Councilman Rubeck. Seconded by Supervisor Chiavetta. All in favor. Motion passed to Adjourn at 5:30 pm on Thursday September 4, 2003.
