MINUTES OF THE DECEMBER 11, 2018 TOWN BOARD MTG


This Regular Meeting of the Brant Town Board was held on Tuesday, December 11, 2018 at the Brant Town Hall, located at 1272 Brant North Collins Rd, Brant, New York at 7:00 PM.

The meeting opened at 7:00 PM with the Pledge of Allegiance.

MINUTE APPROVAL NOVEMBER 13, 2018 REGULAR TOWN BOARD MEETING: Councilman Muffoletto motioned to accept the minutes of the November 13, 2018 Regular Town Board meeting. Councilwoman Marien seconded the motion. 3 ayes, 0 nays. MOTION CARRIED.

SUPERVISOR’S OCTOBER 2018 FINANCIAL REPORT: Councilman Muffoletto moved and was seconded by Councilwoman Marien to accept the Supervisor’s October 2018 Financial Report as presented. 3 ayes, 0 nays. MOTION CARRIED.

Councilwoman Marien moved to approve above Budget modification #6 of 2018 , was seconded by Councilman Muffoletto. A roll call vote was taken: Councilwoman Marien-aye, Councilman Muffoletto-aye, Supervisor DeCarlo-aye. 3 ayes, 0 nays. MOTION CARRIED.

 

TOWN CLERK/TAX COLLECTOR’S OCTOBER 2018 FINANCIAL REPORT: The recording Deputy Town Clerk did not realize the Town Clerk’s financial report is not presented by the Town Clerk during meetings. The Town Board only reviews and approves it within their packets. Therefore, the report was tabled until the January Meeting.

 

COURT CLERK’S OCTOBER 2018 FINANCIAL REPORTS FOR JUSTICES GIER AND KACZMAREK REGULAR AND BAIL ACCOUNTS: Councilman Muffoletto motioned to approve both Bail and Regular Financial accounts for Justice Gier and Justice Kaczmarek for October 2018, and was seconded by Councilwoman Marien. 3 ayes, 0 nays. MOTION CARRIED.

CODE ENFORCEMENT OFFICER’S NOVEMBER 2018 REPORT: Code Enforcement Officer’s November report was read by Code Officer Gary Brecker. Supervisor DeCarlo motioned to approve the report as read, seconded by Councilwoman Marien. 3 ayes, 0 nays. MOTION CARRIED.

Councilman Muffoletto asked the Code Officer if a permit is required to install a home generator. The Code officer responded yes because it requires plumbing for gas.

DOG CONTROL OFFICER’S NOVEMBER 2018 REPORT: Tabled

POLICE REPORT NOVEMBER 2018: The November 2018 Police Report was read by Chief Donald Hepkins. Councilwoman Marien motioned to approve the report as read, seconded by Councilman Muffoletto. 3 ayes, 0 nays. MOTION CARRIED.

HIGHWAY SUPERINTENDENT’S NOVEMBER REPORT: The Highway Report for November 2018 was presented by Councilman Muffoletto. Supervisor DeCarlo motioned to approve the report as read, seconded by Councilwoman Marien. 3 ayes, 0 nays. MOTION CARRIED.

 

TOWN CLERK’S REPORT TO THE BOARD: Deputy Clerk Lynda Ostrowski presented the Town Clerk’s activity report for November. Councilman Muffoletto motioned to approve the report as read, seconded by Councilwoman Marien . 3 ayes, 0 nays. MOTION CARRIED.

 

Councilwoman Marien asked if the other two court clerk’s had been approved to work on the grant. Supervisor DeCarlo stated he will look into it.

 

PLANNING BOARD REPORT: The Planning Board did not conduct a meeting for November.

 

ZONING BOARD OF APPEALS REPORT: No meeting held.

 

RECREATION DIRECTOR’S REPORT: No report presented.

 

PARKS COMMISSIONERS’ REPORT: No report.

 

TOWN HISTORIAN’S REPORT: The Town Historian’s November Report was read by Town Historian Patty Friend. She encouraged the audience to have their mailings postmarked with a special pictorial cancel at the Post office on December 20. She advised there will be no historical meeting held in December. Supervisor DeCarlo motioned to accept the report as read, seconded by Councilwoman Marien. 3 ayes, 0 nays. MOTIONED CARRIED.

 

FIRE COMPANY REPORTS: No reports were presented.

 

SENIORS DECEMBER REPORT: Secretary to the Seniors Lynda Ostrowski presented the minutes of the December 5th meeting. Supervisor DeCarlo motioned to approve the report, seconded by Councilman Muffoletto. 3 ayes, 0 nays. MOTION CARRIED.

 

OLD BUSINESS

SPEED LIMIT SURVEY RESULTS: Debra Ritz stated she was for the reduction in the speed limit. She suggested it be lowered to 45 miles per hour. Supervisor DeCarlo noted that the survey resulted in twenty eight residents in favor of the reduction. Ten were against it, and five had no preference. Based on the majority, Supervisor DeCarlo motioned to send a letter to the appropriate agency to request a reduction to 45 MPH. Councilman Muffoletto seconded the motion. 3 ayes, 0 nays. MOTION CARRIED.

LED STREET LIGHTS: Supervisor DeCarlo stated he is still working on the streetlight conversion. He is looking into other options, and should have answers for the next meeting.

QUOTE FOR HIGH SPEED INTERNET TO THE REC BUILDING: Supervisor DeCarlo noted that he is working on getting the service at no cost.

 

NEW BUSINESS

Supervisor DeCarlo announced a few new appointments to be made. He added that if anyone has questions regarding any of them, he asks they speak up and the appointment will be discussed in an executive session.

RESIGNATION OF JANICE ROSS: In advance of her upcoming position on the Brant Town Board, Councilwoman elect Janice Ross submitted her resignation from her positions on the Planning Board, Board of Assessment and Review member, and as Highway Secretary effective December 31, 2018 . Supervisor DeCarlo motioned to accept the resignation, seconded by Councilwoman Marien. 3 ayes, 0 nays. MOTION CARRIED.

PLANNING BOARD AND BOARD OF ASSESSMENT AND REVIEW APPOINTMENTS: Supervisor DeCarlo motioned to appoint Joseph Ostrowski as a member of the Board of Assessment and Review, and Jason Peters as an Alternate member of the Board of Assessment and Review. He also requested approval to reappoint Joseph Ostrowski as Planning Board Chairman. Councilwoman Marien seconded the motion. 3 AYES, 0 NAYS. MOTION CARRIED.

Supervisor DeCarlo then advised the Board that Diane Czyz has requested the now vacated position of Highway Secretary. He noted the Superintendant’s approval. It was decided that the appointment would be discussed in executive session near the end of the meeting.

 

APPROVAL FOR THE APPOINTMENT OF NEW CARETAKER PART-TIME FOR BUILDING AND GROUNDS: Supervisor DeCarlo motioned to approve the appointment of Eric Russell as part-time Caretaker for Buildings and Grounds at $15.00 per hour limited to 19 hours per week to replace Nick Burbige. Councilman Muffoletto seconded the motion. 3 ayes, 0 nays. MOTION CARRIED.

 

APPOINTMENT OF JASON PETERS AS PLANNING BOARD MEMBER: Supervisor DeCarlo motioned to appoint Jason Peters as Planning Board member to finish the term of Janice Ross. Councilwoman Marien seconded the motion. 3 ayes, 0 nays. MOTION CARRIED.

TOWN BOARD REPORTS:

 

Councilwoman Marien: Attended the Village Board meeting. She noted that Mayor Hoisington would like to speak with the Supervisor about the streetlights and would like to view the proposal. She then thanked the Seniors for the Christmas lunch.

 

Councilman Muffoletto: Checking with Justice Kaczmarek about skating rink. He also asked for authorization to seek proposals for a Grounds maintenance contract in an effort to compare what the Town is spending now. The proposal would be based on the scope of work that is currently done under the direction of Buildings Superintendant Allen Nolan. Debra Ritz asked why, since the Town has three employees for grounds maintenance now. Supervisor DeCarlo stated that the current cost for the three employees is approximately $66,000 and the Town would like to investigate what the same work would cost if contracted out, since the current cost of the department is being questioned.

Correspondence:

 

· Sales tax is up 3.0% from the corresponding payment in 2017, and the Year to date is up 4.96%

· Received a letter from Snyder Law Office regarding the issue of Short-term rentals. Attorney Trask responded that he is requesting an executive session to discuss it.

· Brant Court will provide their annual docket reports.

· Concert Grant award from NYS for 2019 is $1,250.00

Next regular Town Board meeting will be January 8, 2019 at 7:00 PM. Resident Debra Ritz asked when the Orgnazational meeting would be held. Supervisor DeCarlo was not sure. Discussion began about the possibility of holding the Organizational meeting after the Regular meeting on the same night. Attorney Trask advised the Board that the Organizational meeting must be held before the first regular meeting. Supervisor DeCarlo stated he will make a decision on this later.

At 7:35 pm, Supervisor DeCarlo motioned to enter executive session to discuss personnel issues. Actions which may take place will be the appointment of Diane Czyz as Highway Secretary. Councilman Muffoletto seconded the motion to enter executive session. 3 ayes, 0 nays. MOTION CARRIED.

The Deputy Clerk was asked to stay until the end of the executive session in the event an action was taken.

At 8:14 PM, Supervisor DeCarlo motioned to close the executive session, seconded by Councilwoman Marien. 3 ayes, 0 nays. MOTION CARRIED.

At 8:15 PM, Supervisor DeCarlo motioned to adjourn the meeting, seconded by Councilman Muffoletto. 3 ayes, 0 nays. MOTION CARRIED.
