The meeting opened at 7:30 PM with the pledge of allegiance.

 

PRESENTATION OF PROCLAMATION TO GUGINO OUTDOOR POWER EQUIPMENT: Supervisor Pero asked Frank And Susan Gugino, owners of Gugino Outdoor Power Equipment, to approach the bench. The supervisor read the following proclamation:

 

WHEREAS, Gugino Lawn & Garden (Farm Equipment) began business in Brant 1966,

 

WHEREAS, Gugino Farm Equipment has played an integral part in the agricultural well being of our farming community,

 

WHEREAS, the Town of Brant is so ever Grateful for your Commitment & Dedication to the residents of the Town of Brant and the surrounding community,

 

WHEREAS, Gugino Lawn & Garden is one of the longest operating business established in the Town of Brant’s history,

 

WHEREAS, a big reason for the longevity and the success throughout the years, is because of the fair and caring attitude that is demonstrated to all of the customers,

 

WHEREAS, 50 years ago, Frank Gugino had a dream and a vision that has been very successful with wife Susan by his side and continues on today with his daughter Lisa Dimpfl as General Manager,

 

WHEREAS, time does bring about change and change has been welcomed in the evolution of Gugino Farm & Garden to Gugino Outdoor Power Equipment,

 

WHEREAS, Frank & Susan have always given of themselves unselfishly to promote the Town of Brant and continue a family business that has survived 50 years and will continue another 50 as they pass the torch to Lisa & her daughter Alicyn,

MINUTE APPROVAL MAY 10 REGULAR TOWN BOARD MEETING: Councilman Clark motioned to accept the minutes the May 10th 2016 meeting. Councilman Muffoletto seconded the motion. 5 ayes, 0 nays. MOTION CARRIED.

TOWN CLERK’S FINANCIAL REPORT: Councilman Clark motioned to accept the Town Clerk’s April 2016 Regular Financial Report, seconded by Councilman DeCarlo. 5 ayes, 0 nays. MOTION CARRIED.

 

TAX COLLECTOR’S FINANCIAL REPORT Councilman DeCarlo motioned to accept the Town Clerk’s Tax Collection Report, seconded by Councilman Muffoletto. 5 ayes, 0 nays. MOTION CARRIED.

 

COURT CLERK’S APRIL 2016 FINANCIAL REPORTS FOR JUSTICES BORNGRABER & GIER, REGULAR AND BAIL ACCOUNTS: Councilman DeCarlo made the motion to approve both the bail and regular financial reports of both justices. Councilman Kaczmarek seconded the motion. 5 ayes, 0 nays. MOTION CARRIED.

 

CODE ENFORCEMENT OFFICER’S REPORT: Code Officer Gary Brecker presented his May report to the Board. Councilman Clark motioned to accept the report as read, and was seconded by Councilman Kaczmarek. 5 ayes, 0 nays. MOTION CARRIED.

 

DOG CONTROL OFFICER’S MAY 2016 REPORT: Dog Control Officer Barbara Daniel presented her report for May. Councilman Kaczmarek motioned to accept the report as read, seconded by Councilman Clark. 5 ayes, 0 nays. MOTION CARRIED.

 

POLICE REPORT MAY 2016: The May 2016 police report was read by Police Chief Donald Hepkins. Discussion regarding the reduction of speed limits on some of the Town Roads that are currently 55 mph. Councilman Clark would like the speeds reduced to 45. Councilman DeCarlo motioned to approve the report as read and was seconded by Councilman Muffoletto. 5 ayes, 0 nays. MOTION CARRIED.

 

TOWN CLERK MONTHLY ACTIVITY REPORT FOR MAY 2016: The Town Clerk’s monthly activity report for May was read by Clerk Daniel. Councilman Clark motioned to accept the Town Clerk’s monthly activity report for the month of May as presented, and was seconded by Councilman DeCarlo. 5 ayes, 0 nays. MOTION CARRIED.

 

PLANNING BOARD REPORT: Board secretary Lynda Ostrowski presented the planning board’s June 8th report. Supervisor Pero motioned to approve the planning Board’s report as read, and was seconded by Councilman Muffoletto. 5 ayes, 0 nays. MOTION CARRIED.

 

ZONING BOARD REPORT: Secretary Lynda Ostrowski presented the Zoning Board report for the June 6th Meeting. The Zoning Board of Appeals met to review the variance application of Scott Maybee. The Public Hearing will be rescheduled. The applicant was given additional instructions. Councilman DeCarlo motioned to approve the report as read and was seconded by Councilman Muffoletto. 5 ayes, 0 nays. MOTION CARRIED.

 

RECREATION DIRECTOR’S REPORT: Supervisor Pero stated the pool opens June 25th.


PARKS COMMISSIONER’S REPORT: Parks Commissioner and Building Superintendent Allen Nolan stated the Park is ready to go for the season. He noted that the Sr. Community Bldg door project is moving along well. Councilman Clark noted the ball diamond look great. Councilman Muffoletto motioned to approve the report as read, and was seconded by Supervisor Pero. 5 ayes, 0 nays. MOTION CARRIED.

 

TOWN HISTORIAN REPORT: The Town Historian report for the May 18 meeting was presented by Historian Patty Friend. Also, the “Flossie Field” ball diamond pictorial cancel will be available at the Post Office for June 21st. She announced that those who get the pictorial cancel will be entered in to a drawing to win a customized “Flossie Field” ball & bat. Councilman Muffoletto motioned to accept the report as read, and was seconded by Councilman Kaczmarek. 5 ayes, 0 nays. MOTION CARRIED.

 

FIRE DEPARTMENT REPORTS: Councilman Clark noted that Brant Fire Co. responded to 2 fires.
 

SENIOR’S REPORT: Secretary to the Senior’s, Lynda Ostrowski presented the Senior’s monthly report for their June 1st meeting. Supervisor Pero motioned to accept the report as read, and was seconded by Councilman Clark. 5 ayes, 0 nays. MOTION CARRIED.

 

OLD BUSINESS:

 

CDBG GRANT UPDATE (ADA IMPROVEMENTS TO COMMUNITY BLDG ENTRANCE): Supervisor Pero noted that the Grant for the ADA improvements to the entrance door to the Sr. Community Bldg has a 25% match requirement for the Town. The Town is doing a portion of the work and our match will be approximately $6,250. He needs Board approval to spend this portion. Councilman Muffoletto motioned to approve the in-kind match in the amount of $6,250.00 and was seconded by Councilman DeCarlo. A roll call vote was taken: Councilman Muffoletto-aye, Councilman DeCarlo-aye, Councilman Kaczmarek-aye, Councilman Clark-aye, Supervisor Pero-aye. 5 ayes, o nays. MOTION CARRIED.

 

CAMERA SYSTEM: Councilman Muffoletto announced he had the final camera quote options. One option was in the amount of $9,595.00 and the other is in the amount of $7,795.00 plus $99.00 per month for maintenance. He stated it would allow 3 cameras for the garage, 2 for the pool area, and 3 at the recreation building. Councilman Kaczmarek motioned to approve the second option of $7,797.00 plus $99.00 per month maintenance and support. Councilman DeCarlo seconded the motion. A roll call vote was taken: Councilman Kaczmarek-aye, Councilman DeCarlo-aye, Councilman Clark-aye, Councilman Muffoletto-aye, Supervisor Pero-aye. 5 ayes, 0 nays. MOTION CARRIED.

 

FLU SHOTS: Reminder that the Visiting Nurses Association will be holding a flu vaccine clinic at the Senior Community Bldg on October 24th from 10 am to 2 pm.

 

BOOK MOBILE: Reminder that the book mobile will start visiting the Town Hall for convenience of Town residents every 1st and 3rd Friday of every month at 5 pm to 8 Pm. They will also be set up at the Brantfest on Friday the 17th of June.

Code Officer Gary Brecker stated he has never had a problem with them. The facility is well fenced and guarded. Councilman Clark asked if there was a site plan available. CEO Brecker responded that no changes have been made and Attorney Trask confirmed that no site plan is needed if the applicant has made no changes. No Further discussion.

 

The second Special Use Permit renewal to consider was:

Supervisor Pero read the conditions of the Permit “All vehicles, parts, scrap are to be stored within the fenced of the compound”. Code Officer Gary Brecker noted that no changes have been made by the business over the years. No further discussion.

 

The third Special Use Permit renewal to consider was:

Code Enforcement Officer Gary Brecker advised the Board that the Special Use Permit was issued to allow Mr. Clark to build a windmill. He noted that it was his opinion, and interpretation of the law that once it was built, it will no longer need to be renewed. He added that the windmill has not been constructed yet. He asked the Board to address his question.

 

Frank Broughton of Brant North Collins Rd asked if allowing this windmill will open the door to a flood of windmills in town. Councilman Muffoletto responded that this is a personal windmill for his personal use. No further discussion.

 

The fourth Special Use Permit renewal to consider was:

Code Officer Gary Brecker noted that Michael Daniel’s car dealership is not a junkyard. The cars that need to be liquidated are being repaired for sale. Barbara Daniel noted they cannot be sold without passing inspection. Barbara Daniel responded that it’s a slow process since she must follow NYS laws and vehicles purchased at wholesale must be sold according to NYS law. No Further discussion.

 

The fifth Special Use Permit renewal to consider was:

Code Officer Gary Brecker was asked if he recently confirmed that all items being stored are inside the warehouse. The CEO responded yes. No further discussion.

Code Officer Brecker was asked if they applicant is adhering to his conditions of his special use permit. CEO Brecker stated yes. No further discussion.

Code Officer Brecker noted that he has had no problem with Mr. Reynolds, who currently has 10 vehicles on his front lot, and other in the back that are being repaired. No further discussion.

 

The eighth Special Use Permit to consider was:

Code Officer Gary Brecker explained that Mr. Snyder re-applied to lift the limit on the number of cars he could have on his dealer lot. He was granted the right to have as many cars as he can fit on the lot. Councilman Kaczmarek then confirmed that the “unrestricted” means to the number of cars he can have on the lot. CEO Brecker responded yes. No further discussion.

 

The ninth (and final) Special Use Permit to consider was:

Supervisor Pero read aloud the conditions that were placed on the Special Use Permit.

 

Conditions for Special Use Permit being issued on June 9, 2015, effective July 1, 2015, to the following applicant/operator Adam Weitsman.

 

This Special Use Permit allows the applicant/operator to operate a junk and salvage yard located at 1132 Brant-Farnham Road in the Town of Brant, Erie County, New York.

 

By signing below, the applicant/operator understands that the site is not zoned for the permitted use without this special use permit and further understands that the proximity of this site to residential uses requires constant vigilance and consideration of the impact of the junk and salvage yard operations on those neighboring residential properties. Accordingly, the applicant/operator understands and agrees that the following conditions must be strictly followed as a condition of this Special Use Permit which expires June 30, 2016, unless terminated or modified earlier as a result of enforcement proceedings:

 

  1. The hours of operation are limited to the following:

 

7am to 6pm Monday thru Friday. On these days equipment will operate no

earlier than 8am and no later than 5pm. Saturday operation will be from 7am to

4pm and equipment will operate no earlier than 8am and no later than 4pm.

 

Sunday operation is 7am to 2pm with no equipment operations on Sunday.

 

  1. No Weitsman tractor trailers will be inbound after 4pm; but trucks already at the facility being loaded may be loaded and allowed to exit the facility before closing. Hardpan Road will not be used by Weitsman trucks, and all trucks coming to or leaving the facility will be directed to use Route 249 when routing to or from Route 20.

 

  1. The current road side fence along Route 249 and Hardpan Road will be replaced by a block type retaining wall and shall stand at least 8 feet high. The area will be landscaped, and new blacktop in the yard to cut down on dust. Such work to be completed and inspected by Brant Code Enforcement Officer by September 9, 2015.

 

  1. The yard lights will be operated and directed in such a manner as to cause no impact on neighboring residential properties.

 

  1. Applicant/operator will not modify existing site and/or improvements located thereon without first submitting proposed changes to the Town of Brant for approval once the impact of the proposed changes or modifications upon the neighboring residential properties has been assessed and considered. All such changes or modifications shall be presumed to be changes to the allowable use under this special use permit.

 

The conditions were acknowledged by a signature of Adam Weitsman.

 

Code Enforcement Officer Gary Brecker noted that the block wall is up. The lot is currently being paved. He commented that the corner lot has never looked so good.

Public Discussion:

 

  1. Ellis, Brant Farnham Rd: Stated she finds it interesting that Gary Brecker finds no problems with Weitsman, when the DEC was there for less than a half hour and cited them for 4 major violations. They came back on June 1st and cited them for further violations, and served the papers directly to Adam Weitsman. She added that Mr. Weitsman has done nothing he has promised to do. She complained about the recent dust plumes, even though they were recently cited two times. She accused the CEO of lying in order to get Weitsman his permit. There is a thousand dollar fine plus a hundred dollars a day for every day he is in violation.

 

Joseph Wittenzellner, Brant Farnham Rd: Stated Weitsman is not a salvage yard. It is a Scrap processing facility. He complained about the noise from the smashing and breaking apart the scrap. He added that when Weitsman receives complaints, it calms down for a few days, and then it starts up again. He complained that he can’t open his windows and that his car has dust on it right after washing it. He stated that the scrap yard doesn’t do anything until they are cited. He stated that the conditions were supposed to be met by September 15 and it’s still not completed. He complained about the wall moving. He complained that no one in Brant needs the proposed dog park as this is farm country. He added that Weitsman’s facility is a scrap processor, and not a junkyard.

 

Code Officer Brecker noted that the activity being conducted at the Weitsman Facility meets the definition of a junkyard according to the definition in the Brant Town code book. Wittenzellner asked what car part can buy from them?

 

Ellis and Wittenzellner both asked why the lot hasn’t been paved as it was supposed to be complete in July. CEO Brecker explained that they needed approval from the DEC before they could begin paving because it would be illegal to pave over contaminated soil. They now have clearance from DEC and have begun paving. Brecker continued that no one ever complained about the former junkyards that ran that business and contaminated the soil. He added that Weitsman cleaned that place up. Joyce Ellis objected.

 

Frank Broughton, Brant Rd: Spoke for the Weitsman Facility, provided they adhere to the conditions. He added that the property looks much better. He noted that he has to wash his car everyday and he lives on the other side of Town.

 

Brenda Emminger, Brant Farnham Rd: Complained about the moving of the wall. Lights are still on and shining towards their home. They are working past the agreed upon time conditions. There is garbage in the roads, and people are getting flat tires.

 

Aaron Weiner, Weitsman Representative: Apologized for the disruption and inconvenience the project has caused. He noted that the end result will be fantastic. Paving has begun and is 75% complete. Inventory is down, and heavy truck traffic will be limited. Our goal is keep no inventory. Councilman Clark asked where the failure was in determining the conditions which were set. Mr. Weiner responded that he did not have that information. Supervisor Pero noted a few of the conditions such as the progress of the wall. Mr. Weiner stated the wall is 95% complete. He stated there is a little section on the northwest corner that needs to be completed. Mr. Weiner was asked why the fence was moved. Weiner responded that it was to give Ms. Ellis a better view. The empty area is going to be graded and seeded.

 

At 8:30 PM, Supervisor Pero motioned to temporarily adjourn the public hearing to open the next public hearing set for 8:30 PM. He was seconded by Councilman Kacamarek. 5 ayes, 0 nays. MOTION CARRIED.

 

8:30 PM PUBLIC HEARING (6-MONTH MORATORIUM ON ISSUANCE OF PERMITS FOR COMMERCIAL SOLAR PANEL PROJECTS IN THE TOWN OF BRANT):

 

The Town Clerk read the Legal Notice published in the Hamburg SUN:

Pursuant to resolution of the Town Board of the Town of Brant, New York, notice is hereby given that a public hearing will be held by the Brant Town Board in the Brant Town Hall, 1272 Brant-North Collins Road, Brant, New York on the 14th day of June, 2016 at 8:30 P.M. Local Time, for the purpose of considering Proposed Local Law No.2-2016 which, if approved, would impose a 6 month moratorium on the issuance of applications, permits or approvals for Commercial Solar Panel Projects in the Town of Brant.

Copies of the proposed local law are available for review in the office of the Town Clerk. All interested parties will be given an opportunity to be heard.

RE-OPENING OF PUBLIC HEARING FOR REVIEW/RENEWAL OF SPECIAL USE PERMITS: Supervisor Pero motioned to re-open the public hearing regarding the review/renewal of Special Use Permits. He was seconded by Councilman Clark. 5 ayes, 0 nays. MOTION CARRIED.

 

Mr. Aaron Weiner returned to the bench to answer the Boards questions. Councilman Clark asked what the violations were. Mr. Weiner stated he did not know, but stated the facility is working tirelessly to get in compliance. Gary Brecker responded that a while back he spoke with Mr. Zellinski with the DEC and was not told of any violations. He also spoke with the engineer paving the lot and was told Weitsman had to get clearance from the DEC before they could pave because you can’t pave over contaminated soil. Mr. Weiner stated that Weitsman has spent a half a million dollars on this project.

 

Joyce Ellis held up the violations and stated that she sent copies of the violations to the Board members. The violations were given to Ms. Ellis by Mr. Zellinski and Mary Macintosh.

 

  1. Kaczmarek acknowledged the reasons why the wall was moved. He was told by Mr. Lang, a Weitsman representative, who advised Mr. Kaczmarek that they had to get DEC approval to put the wall up. They began the project before the DEC approval came through. When the DEC approval came through, they were instructed to put in a foundation that would allow for the 100 year flood. Therefore, the wall had to be dismantled and swags had to be installed. Ms. Ellis responded with a question as to why it had to be moved so many times.

 

Councilman Clark asked if they could lighten up on weekends. Weiner responded that they have a skeleton staff. They also use the weekends to get ready to ship on Mondays to prevent a backup of inventory.

 

Attorney Trask asked if the facility receives advanced notice of big deliveries that would allow them to restrict the time of deliveries which would reduce traffic. Weiner stated that they can only control their own trucks. Trask noted the three biggest issues: noise (backup beeps & banging, airborne dust, and traffic). He asked how Weitsman can reduce these three. Mr. Weiner stated that its hard to keep metal on metal quiet.

 

Councilman Muffoletto stated that he spoke with Adam Weitsman who informed him there will be no piles higher than the fence. Mr. Weiner confirmed that. Muffoletto then asked if the blocks are going to be one level instead of different heights. Mr. Weiner answered that he didn’t know but would find out for them.

 

Councilman Clark asked if there was any way to control the dust with water. Mr. Weiner answered that they have a tank, and could spray down the piles. Attorney Trask stated that watering the piles of scrap about to be moved could be added as one of the conditions of the renewal.

 

Patty Friend of Brant Farnham Rd asked if the Board could read the violations that Ms. Ellis has with her. Supervisor Pero asked CEO Brecker to read the violations.

 

CEO Brecker read violations dated May 31, 2016.

 

Violation #1) Article 27 2303: Failure to effectively control dust, yard was extremely dusty and no watering was being conducted.

 

  1. #2) Article 27 2303: Failure to prevent fluids from entering surface waters and/or ground water. Staining of surface soils was noted in a couple of locations within the yard and around the waste oil tank.

 

Violation #3) Failure to strictly and continuously control access to the facility by fencing, gates, signs, or natural barriers. DEC noted the wall was taken down and the project was incomplete at that moment.

 

  1. #4) The surface where fluid draining activities are being conducted is not being cleaned daily or more frequently when spillage occurs. The concrete pad was stained with oil.

 

The violations included the provisions necessary to rectify each violation. Another inspection will be conducted by DEC in July.

 

CEO Brecker stated he will contact the DEC regarding the violations. Since the Town permits the facility, they must be kept aware of any violations.

TOWN OF BRANT

PROPOSED LOCAL LAW NO. 2 OF THE YEAR 2016

 

A local law imposing a temporary moratorium on the issuance of applications and the granting of permits, licenses or approvals for the Siting of Commercial Solar Power Projects in the Town of Brant in order to allow for the adoption of appropriate regulations pertaining to such land uses,

 

Be it enacted by the Town Board of the Town of Brant (“Town”) as follows:

 

WHEREAS, in recent weeks, Brant has received a number of inquiries about siting and locating commercial solar panel installations on lands within the Town of Brant, and

 

WHEREAS, current local laws, ordinances and regulations do not adequately address many of the issues and concerns which must be considered to fairly address the impacts of such uses upon the Town, and

 

WHEREAS, the Town Board has determined that it is necessary to protect the public interest and welfare by imposing a temporary moratorium on new siting, location and establishment of Commercial Solar Power Projects while the Town undertakes a comprehensive review of concerns and issues raised by these uses, and

 

WHEREAS, such moratorium is intended to allow the Town sufficient and necessary time to address such concerns and issues and enact new laws, ordinances or regulations, and/or appropriate amendments to existing laws, ordinances or regulations to properly address community impacts, concerns or issues in a manner which is meaningful and consistent with the Town’s comprehensive plan.

 

NOW, THEREFORE, the Town Board of the Town of Brant hereby declares that no new applications shall be issued and no permits or approvals shall be granted by any officer, department, board or agency of the Town of Brant with respect to the siting, location or establishment of Commercial Solar Power Projects within the Town of Brant for a period of six (6) months from the effective date of this local law, unless earlier terminated by other local law, duly adopted.

 

As used in this law, the term “Commercial Solar Panel Project(s)” shall mean and include, but not be limited to, an array or collection of photovoltaic panels or collectors that convert sunlight to electrical energy and which, together with appurtenant facilities, covers an aggregate area of land greater than 1500 square feet. Residential, business and industrial properties with rooftop solar panel installations which generate electricity solely servicing the property where the rooftop installations are located are exempt from this moratorium as are all municipal and school

installations and properties.

 

This local law is intended to supersede all applicable provisions of the Town of Brant Code, to the extent required to give effect to the provisions hereof for the effective period hereof.

Attorney Trask advised the Board that if this Special Use Permit was not subject to annual renewals, then there is nothing to renew, regardless if construction has started or not. Trask noted that the Radio tower Special Use permit was absent from this meeting. He advised Brecker to look into the conditions of that Tower to make sure it isn’t subject to renewal. Supervisor Pero asked why Towers and windmill Special Use Permits would need to be renewed. Trask noted that structures, such as the Radio Tower need periodic structural certifications about its safety. And with cell towers, most communities require a bond to be in place because if the Tower was abandoned, the Town is stuck with this structure that is now a safety hazard. This should be confirmed annually.

 

After much discussion, Attorney Trask advised the Board to table the Timothy Clark Special Use Permit renewal until the July meeting. Supervisor Pero motioned to table the permit, and Councilman Muffoletto seconded the motion. 5 ayes, 0 nays. Motion carried.

After brief discussion by Supervisor Pero, Attorney Trask presented the following suggested language for the Special Use Permit to be proposed for The Ben Weitsman of Brant, LLC application for renewal:

 

Resolution #1 RELATED TO WEITSMAN SPECIAL USE PERMIT

"Motion to approve extension of the Weitsman Special Use Permit to operate a junk and salvage yard at 1132 Brant-Farnham Road for a period of 30 days to allow the permittee to submit to the Town Board an updated site plan no later than July 5, 2016, showing all improvements and features of the site, subject to approval of the town board. This 30 day extension will also allow the town to enter into an inter-municipal agreement for code enforcement services to enforce the Weitsman Special Use Permit going forward. All other conditions of the Special Use Permit that are in the current Permit to remain in effect during this 30 day extension period.

 

The intention is for the Town Board to consider the full annual renewal of the Weitsman permit at its next monthly meeting."

 

Upon reading the resolution, Supervisor Pero objected to the offer of entering into an inter-municipal agreement with another municipality for Code Enforcement services. Supervisor Pero strongly disagreed with the resolution as it was written. Councilman Clark responded that the consensus of the Board was to adopt the resolution as it was presented.

 

At this time Councilman Clark motioned to adopt the resolution as presented, and was seconded by Councilman DeCarlo. A roll call vote was taken: Councilman Clark-aye, Councilman DeCarlo-aye, Councilman Kaczmarek-aye, Councilman Muffoletto-aye, Supervisor Pero-nay. 4 ayes, 1 nay. MOTION CARRIED.

 

 

 

Resolution #2 RELATED TO WEITSMAN SPECIAL USE PERMIT

"WHEREAS, The Special Use Permit issued to Weitsman last year contained some important conditions which were designed to mitigate possible negative impacts on residential neighbors, such as regulating traffic and hours of operation and requiring some new screening and blacktopping to reduce visual, noise and airborne impacts on neighbors, and

 

WHEREAS, During the last 12 months, enforcement of some of these permit conditions fell short of what was expected and the town board now feels the need to bring in outside assistance to restore a level of confidence relative to enforcement of this particular Permit.

 

NOW THEREFORE, it is RESOLVED that the Town of Brant negotiate the terms of an inter-municipal agreement with the Town or Village of North Collins to provide code enforcement services on the Weitsman Special Use Permit going forward. Under this plan, the current code enforcement officer will have no future role relative to the Weitsman Permit."

 

Supervisor Pero again objected to the proposed resolution which would allow the contracting of Code Enforcement Services with the Town of North Collins. Pero asked Councilman Clark if he had already sought the services of the CEO prior to this meeting.

 

Councilman Clark motioned to adopt the resolution as presented, and was seconded by Councilman DeCarlo. A roll call vote was taken: Councilman Clark-aye, Councilman DeCarlo-aye, Councilman Kaczmarek-aye, Councilman Muffoletto-aye, Supervisor Pero-nay. 4 ayes, 1 nay. MOTION CARRIED.

 

The Hearing on Special Use Permits concluded at 9:27 PM.

 

 

Councilman Muffoletto asked what is happening with National Fuel on Cain Road. He noted that the six month permit was issued two years ago for National Fuel to use Dale John’s property while they do pipe repairs. Code Officer Gary Brecker responded that what is left at the John property is lumber. National Fuel intends on moving to Milestrip now to begin repairs on pipes that are leaking. He requests the Board to extend the Permit to allow them to do so. Attorney Trask responded that Special Use permits are not transferable from one geographic location to another. CEO Brecker answered that the utility company has moved their equipment, but the property owner is asking National Fuel to allow him to keep the lumber. Brecker also stated that the new special use permit application is on its way. He had spoken with the utility company’s attorney about it. Councilman Muffoletto requested Brecker to see who owns the lumber. Brecker noted he also expects to have a new special use permit application by next Board meeting.

BRANT RECREATION APPOINTMENTS: Supervisor Pero read the names of returning counselors for the Brant Recreation program. The returning, and new counselors will be paid $9.00 with the exception of Hannah Renaldo, who will be paid $10.00 per hour during the Recreation Director’s absence). NEW POLICE DESKTOP COMPUTER: Supervisor Pero acknowledged a request from Police Chief Donald Hepkins to purchase a new desktop computer. The current one is from 2010 and can no longer be updated. It is no longer compatible with current software. Attached to his letter of request was a quote he received from I.T. person David Sink. The quote was for a Dell Optiplex 3020 Small Form Factor (BTX) in the amount of $588.73. Chief requested the Board approve a $650.00 cap on the new computer in case it fails to meet Central Police Services requirements and another computer must be purchased. Supervisor Pero motioned to approve the purchase with a cap of $650 and was seconded by Councilman Muffoletto.   • SPEED REDUCTION REQUEST FOR MILESTRIP RD: Councilman Clark read a letter he sent to Legislator Mills requesting speed reduction on Milestrip Rd between Route 62 and the reservation. He noted the response he received from Legislator Mills stated the request must come from the Town Board in the form of a resolution, and be sent to William Gary, Commissioner of the Dept of Highway. Councilman Clark motioned to approve sending a resolution, and was seconded by Councilman Kaczmarek. MISCELLANEOUS INFORMATION:

 

  • Department of Public Works is holding public statement hearings regarding proposed increases in National Fuel gas prices. The hearings will be held on June 28 at the Amherst Municipal Bldg at 4 and 7 pm and on June 29 in Jamestown at 3 pm and 6 pm. The information is available in Supervisor Office for anyone interested.
  • Letter from Susan Meyers, property owner of a lot located in the Wide Beach subdivision. They drove to the lot and discovered their neighbor had their dog on their lot. They have No Trespassing signs on the property. She asked the Brant Police to patrol the area and enforce the No Trespassing signs. They are fearful of someone getting hurt on the property. Supervisor Pero presented two bills that did not make it on the abstract in time. He requests approval to prepay them on Abstract 7.

 

· Linda Giancarlo “Linda Dee” band $400.00

 

Supervisor Pero motioned to approve payment of $400.00 for Linda Giancarlo as a prepay on Abstract 7, seconded by Councilman DeCarlo. · Midlife Crisis Band $500.00

 

Supervisor Pero motioned to approve payment of $500.00 for Midlife Crisis Band as a prepay on Abstract 7, seconded by Councilman Clark. NEXT TOWN BOARD MTG JULY 12, 2016 AT 7:30 PM (7:30 pm June thru Sept)

 

  1. Muffoletto then announced that in response to multiple complaints of Town equipment and vehicles being used for personal business, he drafted the following resolution, and requests the Board adopt it.

 

“BE IT RESOLVED, no personal use of Town equipment and/or Town owned vehicles is permitted. All Town of Brant employees, elected officials and appointed officials shall use Town owned equipment and vehicles for Town business only.”

 

Councilman Clark asked if there was anything in the Handbook policy regarding this. Supervisor Pero suggested tabling the resolution until the Board had a chance to look in the Employee Handbook regarding use of Town Vehicles. He also would like to place it on the agenda for next month. No further discussion.

 

Councilman DeCarlo then stated that he forgot to thank Patty Friend for all her help during the Brantfest also.

 

At 9:58 PM Supervisor Pero motioned to adjourn the meeting in memory of John Carriero who recently passed away. The Board seconded motion. 5 ayes, 0 nays. MEETING ADJOURNED.
