This Regular Meeting of the Brant Town Board was held on Tuesday, September 11, 2012 at the Brant Town Hall, located at 1272 Brant North Collins Rd, Brant, New York at 7:30 PM.

The meeting opened at 7:30 PM with a pledge to the Flag.

MINUTE APPROVAL:
	A Motion was made by Councilman Gier, and seconded by Councilman Borngraber to accept the minutes of the August 14, 2012 Regular Town Board Mtg. and the August 22, 2012 Work Shop   5 ayes, 0 nays.  MOTION CARRIED.

MONTHLY REPORTS:

SUPERVISOR?S FINANCIAL REPORT & BUDGET MODIFICATION:

Councilman Gier moved and was seconded by Councilman Kaczmarek, to accept the Supervisor?s July 2012 Financial Report.  5 ayes, 0 nays.  MOTION CARRIED.

Councilman Clark moved and was seconded by Councilman Gier, to accept the following Budget Modification as of July 2012 as presented below.  A roll call vote was taken: Councilman Clark-aye, Councilman Gier-aye, Councilman Kaczmarek-aye, Councilman Borngraber-aye, Supervisor Pero-aye.  5 ayes, 0 nays.  MOTION CARRIED.

TOWN CLERK?S REGULAR FINANCIAL REPORT AS PRESENTED:
Councilman Gier moved to accept the Town Clerk?s July 2012 Financial Report & the Tax collection summary report, and was seconded by Councilman Borngraber. 5 ayes, 0 nays.  MOTION CARRIED.

COURT CLERK?S FINANCIAL REPORT:
	Councilman Clark moved to accept the Court Clerk?s July 2012 Financial Report for Justice Gugino and Justice Crouse.  Councilman Kaczmarek seconded the motion.  5 ayes, 0 nays. MOTION CARRED.

CODE ENFORCEMENT OFFICER?S REPORT:
	Code Enforcement Officer Gary Brecker presented the August Report. The topic of abandoned houses in the town was discussed. A Motion was made by Councilman Gier and seconded by Councilman Kaczmarek to accept the report as presented. 5 ayes, 0 nays.  MOTION CARRIED.

DOG CONTROL OFFICER?S REPORT
The August Dog Control Officer?s report was read by Dog Control Officer Barbara Daniel. Councilman Clark moved to accept the Dog Control Officer?s August report.  The motion was seconded by Supervisor Pero. 5 ayes, 0 nays. MOTION CARRIED.

POLICE REPORT:
              Councilmen Gier moved to accept the August 2012 Police report as presented by Police Chief Donald Hepkins.  It was seconded by Councilman Kaczmarek. 5 ayes, 0 nays.  MOTION CARRIED.  

TOWN CLERK?S REPORT TO THE BOARD:
	Supervisor Pero moved to accept the Town Clerk?s August 2012 Monthly Activity Report to the Board.  Councilman Borngraber seconded the motion.  5 ayes, 0 nays. MOTION CARRIED.


PLANNING BOARD REPORT:	Planning Board had no meeting in August.

RECREATION DIRECTOR?S REPORT:  
               No Report.


PARKS COMMISSIONER?S REPORT: 
Supervisor Pero noted that the Pool house is painted, millings have been put down on the walking paths, the weeds were sprayed. The football and soccer fields were rolled, the window sills and the picnic tables were painted. The Butterfly garden is looking better. The fence by the basketball court needs to be painted. The pump house and highway garage will be painted and we need fill in the playground.
	 Councilman Gier moved to approve the Parks Commissioner?s report as read, and was seconded by Councilman Kaczmarek.  5 ayes, 0 nays.  MOTION CARRIED

Town Historian Report:
	No Report.

Fire Department Reports:  Councilman Gier stated that he received reports from Farnham.  They had 32 alarms in July and 18 in August.  He received no report from Brant or North Collins.  Supervisor Pero moved to approve the report and, and was seconded by Councilman Borngraber.  5 ayes, 0 nays.  MOTION CARRIED.

Brant Farnham Senior?s report : No Report.

OLD BUSINESS:

Football Field Lights: Councilman Kaczmarek reported the Lights are up and running. A fence is needed for around the Transformer. 

Park building roofs:
Councilman Gier to look into pricing for the roof work.  Recreation porch roof needs to be done first.

Water Project:  Supervisor Pero will begin conducting a survey in the area to determine the level of interest. 

Phase II of the Park Project: Supervisor Pero is asking for the Board to give him approval to go into a contract with CRA to draw up the plans and specs and has to be stamped. A Motion was made by Councilman Gier, seconded by Councilman Clark for Supervisor Pero to enter into a contract with CRA, with a cap of $2500.00. Motion carried. Roll call vote: Councilman Gier, aye

Food Pantry: Supervisor Pero announced the food pantry will be held every third Wednesday starting September 19, 2012.  Location, Sr. Community Bldg, time 1:30 to 3:30 PM.

Winter Recreation:  For children residing in our town . Every Saturday for 8 weeks, no more than 50 kids, 10 Kids per counselor. Approximate cost $3500.00 to the town. It would start in January. Councilman Gier voiced that he was not in favor of it.   TABLED.



Seneca Resolution: Supervisor Pero read the following Resolution: Motion was made by Supervisor Pero and seconded by Councilman Gier. A roll Call vote was taken: Supervisor Pero-aye, Councilman Kaczmarek-aye, Councilman Clark-aye, Councilman Gier-aye, Councilman Borngraber-aye.  5 Ayes, 0 nays.   Resolution Carried. School Tax Collection: Supervisor Pero stated that the Lakeshore School Board tabled until next year. It is not a Town Function. A Town of 2nd class is not obligated to collect the school tax. The topic will be discussed at the next workshop on October 3rd, 2012.

New Business

Ground Water Impact Law: Joe Ostrowski explained to the public what the law stands for and it is to protect the aquifer. Set a Public Hearing, for October 9, 2012 at 8:00 PM. Councilman Gier thanked Planning Board Chairman Joe Ostrowski for all his effort and input.

Sign Regulation Law:  Supervisor Pero spoke with other Town Supervisors regarding Political Signs, you cannot hinder a 1st amendment right and they are only there for a short time. If you start regulating them you will have problems. Supervisor Pero tabled until next meeting.

National Grid Energy Savings Plan:  Supervisor Pero received a call from David Babe with National Grid Lighting Proposals.   He went through our buildings; the Hwy Garage, Salt Shed, Community Bldg and the lighting could be upgraded at a cost of$ 8,669.68. National Grid would pay $6068.78 and the town portion would be $2,600.  The total estimated KW hours being saved would be 27, 234.48 Kw hr. which is a savings of $3028.47. In one year it would pay for the town portion of $2600.00. It can be paid in one payment or in 12 monthly payments of $ 216.74 or a 2 year 24 month plan of $180.37 or $2,210.00, which would be a 15% savings. A motion was made by Supervisor Pero seconded by Councilman Gier and Councilman Clark for Supervisor Pero to negotiate and sign and go further with this agreement. Pre Pay Policy Amendment: We are having a problem with paying our credit card. Supervisor Pero wants to add Payment of Credit Card to the current Pre-Pay List. The total amount on the Credit Card would have to be approved. A Motion was made by Supervisor Pero, seconded by Councilman Gier to add the payment of the credit card to the Pre-Pay list. Library Resolution:  Supervisor Pero received a copy of a Resolution from Supervisor Nellis.  He presented it to the Brant Town Board for review and adoption.  The resolution was adopted with a roll call vote: Supervisor Pero-aye, Councilman Kaczmarek-aye, Councilman Clark-aye, Councilman Gier-aye, Councilman Borngraber-aye.  5 ayes, 0 nays. Miscellaneous: Supervisor Pero said he was contacted by the Officer in Charge for the Brant Post Office that there is a possibility of the Post Office Closing or possibly days being cut. A meeting is going to be held for the public on Monday, October 22, 2012 at the Community Building from 4:30 to 7:00 pm.  (CLERK'S NOTE: THIS MEETING WAS LATER CHANGED TO NOVEMBER 8th 5:00 PM TO 6:30 PM).

Resolution for the Court System: Supervisor Pero read the following resolution:


     WHEREAS, a motion was made by Supervisor Clark, seconded by the whole board to approve the adoption of the following resolution:
     WHEREAS, the Justice Court Assistance Program was established by the New York State Legislator as an ongoing vehicle by which the State can assist Towns and Villages in the operation of their Justice Courts;
      WHEREAS, the State of New York Unified Court System is entertaining applications for the Justice Court Assistance Program with an October 1st, 2012 deadline;
      BE IT RESOLVED, that the Town Board of Brant does hereby authorize Justice Linda Crouse to prepare and the Supervisor to sign and submit a grant application entitled;
      NYS UNIFIED COURT SYSTEM JUSTICE COURT ASSISTANCE PROGRAM and if awarded, to be the official representative in connection with the application, providing any additional information, if required, and to fully comply with the execution of the contract.

REPORT OF COMMITTEES:

JEFF GIER stated that we need to streamline our purchasing. We need to come up with a plan to eliminate all the needless trips. Try to have better control of what goes in and out.

CLARK BORNGRABER ? No Report

Chad Kaczmarek ? One half of the records have been moved from the old town hall. Supervisor Pero said as soon as the rest is moved we can put the building up for sale. 

Don Clark- questioned the water testing from Erie County Water. Supervisor said he talked with Jay Patronik, it had to do with the pool but it actually had to do with the Rec. Bldg.  He wrote a letter stating when the building was in use.   Jay said he didn?t have reports of water being tested since last year. The records were found and sent in to him accordingly. From now on Councilman Kaczmarek will be responsible for the testing of the water at the rec building. The Village of Farnham, at their last board meeting, questioned how long is the response time for street lights that have been reported out? Supervisor Pero said it varies. They also requested an updated recycling schedule. Town Clerk Daniel said she has emailed it to them and it is on the website.

Leonard Pero ? Stated that he had a notification from South-towns Community Enhancement Coalition of the Towns Annual dues of $1000.00. Motion made by Supervisor Pero and seconded by Councilman Gier to pay the annual dues of $1000.00. Roll Call Vote:  Supervisor  Pero, aye

The speed limit on Brant Angola Road will go back to 40 mph.

The Garbage Contract is coming due. Put out an RFP at the next workshop. Councilman Gier will work with the Supervisor on the upcoming contract.

Supervisor stated that we need new updated Fire Contracts with the Village of Farnham and the Town of Brant. The North Collins contracts are in effect till 2014.  Councilman Gier and Councilman Kaczmarek will work on this.

Supervisor will work with Town Accountant, Dick Gryksa and Michele on a new Town of Brant handbook.

Supervisor Pero told Councilman Clark he would like an invoice from Tim Clark on the work he did at the park.

Lakeshore Benefit Concert might be held at the American Legion due to the weather.

Fax Phone Line- Rural Transit and Pool have the same line which is a conflict.  Supervisor Pero will look into a new line.

Supervisor stated that the date of the next workshop will be on Wednesday, October 3, 2012 at 6:30 pm.  They will discuss the handbook and the Tentative Budget.

RECOGNIZED PRIVILEGE OF THE FLOOR

Lee Brunelli questioned why the park gates have been left open.  He said why do we have gates if we don?t lock them? Supervisor Pero referred to workers being there to paint and the football kids too. Councilman Kaczmarek will start locking the gates at night.

Attorney William Trask announced that there will be a benefit on Saturday, October 13, 2012 at 7:00 PM at the Highland Fire Hall for his niece, Ann Marie Grise/ Walker, a 38 Yr Old single mother, of two children with Stage 3 breast cancer. This will help cover some of her living expenses. 

Mike Muffoletto questioned why do we even have the gates at the Town Park?  Attorney Trask answered they are for Vehicle Traffic Control.  Supervisor Pero will look into setting up a schedule for the opening and closing of the gates.

CORRESPONDENCE

?	Supervisor Pero wrote a letter to National Grid requesting a Pole light outside of 10862 Mile Block Road in front of Fullone?s Trucking.  The light will be located on Pole 53. National Grid will put it on their schedule.

?	Supervisor Pero received an advertisement from Time Warner regarding changes.

?	Senator Patrick Gallivan, Supporting the Crack Down on Prescription Drug abuse.

?	Supervisor Pero noted that he attended 17 Meetings in the month of August.

?	Councilman Clark mentioned that the parking lot is starting to break up and get holes. Councilman Gier will look into and talk to Joe Giambrone.

A Motion was made by Councilman Gier, seconded by Councilman Kaczmarek to Adjourn in memory of Carmella Clark and In Honor of 911 victims. A Moment of Silence was observed.  5 ayes, 0 nay.  Meeting adjourned.
