Minutes of regular meeting with bid opening for Town Lawn Maintenance of the Brant Town Board which was held on Tuesday March 13th, 2007 at 7:30 PM, 1294 Brant North Collins Road, Brant, New York at the Brant Town Hall. Supervisor Pero made a short announcement to the audience: We are all here for the taxpayers and residents of the Town of Brant and nothing at this meeting should be taken personally. This is about a Town Board meeting making decisions in the best interest of the Town for its residents. PLEASE TAKE NOTICE that sealed bids are hereby requested on the following, in accordance with the specifications on file in the Town Clerk?s Office. Brant Town Parks and Town Hall Lawn mowing, grounds maintenance, ball field maintenance, park trash clean up, snow removal of entrances at Town Hall should also be included. The Brant Town Board reserves the right to accept/reject any all quotes, one year contracts only. Bid specs can be obtained at the Town Clerk?s Office at 1294 Brant North Collins Road during normal business hours, by calling (716) 549-0282, or on our website @ brantny.com under Town Bulletin. Bids must be received at the Town Clerk?s office by March 13th, 2007 at 8:00 p.m. when bids will be opened publicly. Thea Ells opened the one bid received from DM&K Enterprises Ltd. for $12,800.00 for a one year bid April 2007- April 2008 contract Locations include Town Hall grounds & snow shoveling, Memorial Park, grounds only, Town Park grounds only including ball field preparation, DM&K is currently insured up to $3,000,000.00. Allen Nolan answered when the Board asked that the hourly rate is $25.00 per hour, per man. On the advisement of Attorney Trask the board did not take action on the bid Supervisors? answers to last month?s questions: Councilman Chiavetta responded to the complaint/concern about delayed trash pick up and informed those in attendance that Westfield has an excellent record and will do everything possible to pick up on time. Supervisor Pero reviewed the refuse costs, bid amounts, and compared costs to year before. Acknowledgment of Visitors was opened by Supervisor Pero. Ron Kobel asked again about the sewer increases on the 2007 taxes. Pero and Arrigo referred the increase to numerous updates and explained that the Town has no input in the Authorities (sewer and water) charges. Erie County Governments is attempting to open discussion with the Authorities to better understand charges, increases and whose regulations are they under. Kirk Ritz questioned the interpretation by the Town Code Officer concerning private air strip and asked when the Town will be acting on the Law. Ritz questioned an increase in the Town Tax and was answered that the General B Fund went up due to refuse, increase in fire protection, and small percentage increase for highway and lighting. George Cordia inquired of the Supervisor what happened with his position as laborer with the Highway Department as he was told he was not to work. Pero asked if he was currently working for the Highway and Cordia said yes; Pero added that positions are discussed and when appointments are approved and until an individual is told otherwise by the Supervisors office they are approved. Acknowledgment of Visitors was closed. OLD BUSINESS: PC UPDATE: As Councilman Chiavetta was to oversee purchase/lease of computers for the town clerks office, police department, and supervisors office he reported that all are up and running and under budget so far. TOWN PHONE SYSTEM/CELL PHONE POLICY: Table till next month. SCHOOL CLOSING UPDATE: Peter Gugino represented the Board at a recent meeting and came back with the following information: The School board had a committee formed who reviewed the situation in the district of enrollment figures down and costs up as to the most economical solution: the committee recommended the closing of one of three elementary schools in the district, namely Waugh, Hoag , or Brant. Gugino reviewed some of the findings the committee reported after fourteen hours of meeting such as; the district has spent $4.5 million to upgrade the three schools, the costs of closing each building. Gugino and others questioned if they considered the closing of the area catholic schools, the growth of the housing in our communities and the cost of building a new school. All were in agreement that the communities have to be involved as the closing of one of the schools is a decision the school board will be considering. Civil Service Compliance: In response to a letter received from Erie County Civil Service the Supervisors office responded with verification that the three elected assessors? positions were changed by Local Law #4 of 2002. NEW BUSINESS: Councilman Gier moved for the adoption of the following RESOLUTION 031307-#53 for acceptable training for Planning and Zoning Board of Appeals members, seconded by Councilman Chiavetta, A roll call vote was taken: 5 Ayes 0 Nays Councilman Gier Voting Aye Councilman Chiavetta Voting Aye Supervisor Pero Voting Aye Councilman Arrigo Voting Aye Councilwoman Turner Voting Aye WHEREAS, town law sections 267 and 271, village law sections 7-712 and 7-718, and general city law sections 27 and 81 provide that a planning board or zoning board of appeals members in New York State as well as alternate members of those boards must complete a minimum of training each year; and WHEREAS the above sections of state law provide that a planning board or zoning board of appeals member shall not be eligible for reappointment to such board if they have not completed the training required by law; and Whereas the above sections of state law provide that the legislative body of the town, village and city specifies which activities qualify as training to satisfy the state requirements; NOW THEREFORE BE IT RESOLVED, that the following list of agencies, commissions, associations, universities, and other organizations are approved to provide training to meet the state requirements when the training they provide pertains to municipal planning, zoning, community design, environmental issues economic development and local government functions and practices; 1) the NYS Department of State; Dept of Ag & Mkts; Office of the State Comptroller; Dept of Health; Dept. of Transportation; Dept. of Environment conserve.; Office of Parks, Recreation and Historic Preservation; Hudson River Valley Greenway; and 2) 2) NYS Ass. AND LET IT FURTHER be RESOLVED, that other training activities may approved on a case-by-case basis by the Town Board upon the request of a planning board or zoning board of appeals member; and be it further RESOLVED, that any new member appointed to fill the last 12 months of a term shall not be required to have training to be reappointed to a first full term, but must thereafter comply with the municipal training policy as provided elsewhere herein; and be it further RESOLVED, that training received by a planning board member or zoning board of appeals member in excess of four hours in any one year may be carried over by the member into succeeding years; and be it further RESOLVED, that the Town Clerk shall create and maintain a system of tracking the training individual members complete annually; and such information shall be presented to the town board prior to considering a member for reappointment. Councilman Gier moved for the adoption of Resolution 031307-#54 of the Brant Town Board Supporting Proposed Legislation Criminalizing Use of the Internet to Commit a Sex Crime Against a Child, seconded by Councilman Arrigo, A roll call vote was taken: 5 Ayes 0 Nays Councilman Gier Voting Aye Councilman Arrigo Voting Aye Supervisor Pero Voting Aye Councilwoman Turner Voting Aye Councilman Chiavetta Voting Aye ADOPTED:WHEREAS, many sex offenders utilize computers and the internet to prey upon children by communicating with these children using fictitious identities in order to entice children to meet with them with the ultimate goal of engaging in sex with children, and WHEREAS, the pervasiveness of and easy access to the internet has made children increasingly vulnerable to such activities, and WHEREAS, everything possible should be done to protect our children from becoming victims of this outrageous, predatory conduct, and WHEREAS, State Assemblyman Jack Quinn, has sponsored a bill in the State Assembly (A5463) which would enact a new law (Article 495 - Computer Sex Crimes Against Children) to make it a separate crime to use the internet to facilitate the commission of a sex crime against a child and to make such criminal conduct subject to severe criminal penalties, and WHEREAS, this Board feels that this proposed legislation is worthwhile and would add an additional deterrent to sex offenders in New York State, NOW, THEREFORE, BE IT RESOLVED, that this Town Board hereby urges the New York State Legislature and Governor to enact Assembly Bill No. 5463 to criminalize use of the internet to facilitate commission of a sex crime against children and to mandate stricter penalties against those who use the internet to commit sex crimes against children, and RESOLVED, that the Town Clerk be and hereby is authorized and directed to send certified copies of this resolution to Assemblyman Jack Quinn, Senator Dale Volker and Governor Elliot Spitzer. Supervisor Pero read a letter from residents Jeff & Ann Prince who are requesting the Town have a link to a sex offender list which is user friendly and have available offenders residing in the area. Request is being referred to Attorney Trask. Councilwoman Turner moved for the adoption of BOND ANTICIPATION NOTE Resolution 031307-#55 DATED MARCH 13, 2007 FOR ISSUANCE AND SALE OF NOTE OF THE TOWN OF BRANT, BRANT, NEW YORK, IN ANTICIPATION OF SALE OF THIRTY THOUSAND DOLLARS ($30,000.00) SERIAL BOND., seconded by Councilman Chiavetta, A roll call vote was taken: 5 Ayes 0 Nays Councilwoman Turner Voting Aye Councilman Chiavetta Voting Aye Supervisor Pero Voting Aye Councilman Arrigo Voting Aye Councilman Gier Voting Aye WHEREAS, the Town Board of the Town of Brant, Brant, New York, hereby authorizes the issuance of $30,000.00 Serial Bonds for the EXTENSION OF BRANT WATER DISTRICT WATERLINE, SURFSIDE DRIVE, BRANT, NY, IN THE AMOUNT OF THIRTY THOUSAND DOLLARS ($30,000.00) for the Town of Brant and provided that the total cost of $30,000.00 or such portion thereof as may be necessary, be paid from the proceeds of obligations issued pursuant to the Local Finance Law, and WHEREAS, the Town Board of the Town of Brant now desires to provide for issuance and form of a Bond Anticipation Note for the aforesaid Bond Anticipation Note, and other matters connected therewith, be it this 13th day of March, 2007. RESOLVED by the Town Board of the Town of Brant as follows: Section 1. A Bond Anticipation Note in the amount of $30,000.00 shall be issued by the Town of Brant for the purpose of aforesaid and in anticipation of the sale of Serial Bonds of this Town in the amount of THIRTY THOUSAND DOLLARS ($30,000.00) heretofore authorized by Resolution adopted at the March 13, 2007, meeting entitled "Bond Anticipation Note Resolution." Section 2. The note will be dated March 28, 2007, or such later date as the officers by their execution thereof will determine, will mature on March 27, 2008, will bear interest at a rate determined by the Town Board upon acceptance of a bid for the sale of said bond, will be payable as to both principal and interest in lawful money of the United States of America at the Evans National Bank, County of Erie and State of New York and will be signed in the name of the Town of Brant by the Supervisor and Town Clerk of said Town, and will be sealed with the seal of the Town of Brant. Section 3. The Bond Anticipation Note shall be of substantially the following terms, form and contents, to wit: UNITED STATES OF AMERICA STATE OF NEW YORK COUNTY OF ERIE TOWN OF BRANT BRANT WATER DISTRICT BOND ANTICIPATION NOTE, 2007 $30,000.00 The Town of Brant, Brant Water District, in the County of Erie, a municipality of the State of New York, hereinafter called the Obligor, hereby acknowledges itself indebted, and for value received promises to pay to the bearer of this note, or if it be registered, to the registered holder the sum of THIRTY THOUSAND DOLLARS ($30,000.00) on the 27th day of March, 2008, together with interest thereon from the date hereof at the rate of 4.7% per annum, payable at maturity. Both principal and interest on this note will be paid in lawful money of the United States of America at Evans National Bank, Angola, New York. Pero as Supervisor of our organization, the Town of Brant, is hereby authorized to sign legal documents related to the legislative member item appropriation PKS-05-NI-077 in the amount of $5,000 for the purchase of playground equipment at the Brant Town Park. Supervisor Pero reported to the Board that as the town has loans with the USDA such as for the water district, USDA has requirements and guidelines that the town had agreed to comply with. There were a number of items that are being taken care of; paper towel holders at wheel chair height, under sink piping wrapping, entrance improvements, additions to town stationary and compliance with hiring handicap, etc. These items are being resolved. Councilman Gier moved for the adoption of resolution 57-07, seconded by Supervisor Pero 5 Ayes Pero, Arrigo, Gier, Turner, Chiavetta 0 Nays ADOPTED: TO HOLD A PUBLIC HEARING FOR PROPOSED LOCAL LAW #1 OF 2007 MANDATED UNIFORM CODE LAW: SUCH LAW WOULD ENACT NEW PROVISIONS FOR ADMINISTRATION AND ENFORCEMENT OF THE UNFUNDED MANDATED NYS UNIFORM BUILDING CODES AND THE NYS ENERGY AND CONSERVATION BUILDING CODES FOR APRIL 10 AT 8:00 PM Reports of committees Councilman Gier stated that he has an employee handbook to look over with the board members at the next work shop. Gier and Arrigo will work on together. Supervisor Pero reported on some town projects: Surfside water extension ? funding, plans, getting approval from Erie county, and bids accepted, all has been done. Economic Dev Comm.- met with Erie County Planning, Seneca nation concerning Route 5 and lake area development and Route 20. Town park ? survey and appraisal being done and contract (grant) signed. Senior building plans are going forward for new stove, fridge, storage area, door, windows and patio. Memorial Park light s are ready to put on, clock is shipping next week. Town Hall small updates have been done, CEO office, storage area upstairs, PC?s are almost done, coffee area in hall. Grant work is being completed. Signs are in to put at welcome points to Town; backhoe will be in soon, code book is on line. Park Acquisition committee (Pero, Gier, Ells) will meet on Wednesday March 21st at 6:30 PM. Pero reviewed some ideas that are being considered: playground in back area by tennis courts, wading pool renovated to a sand box, new land turned over and walkway placed next year. The new addition will be done in three phases as mentioned clean up, seeding and playground development, walkway and park plan in 2008. Pero announced the Brant Summer fest will be held on Sunday June 24 from noon till 8:00 PM Parade at 1:00 PM possible softball games, chicken barbeque, beer tent and strawberries. Energy committee - namely Bill Henry has worked hard to bring installation of solar power panels etc to western New York, and is working on hosting energy fair. Town Board Reports Jeff Gier thanked all for cards and prayers, and mentioned Lake Shore Hospital, thanked Highway for all the great work on the Town roads. John Chiavetta thanked Sherman Reickart for all his work on the new PC?s, his attention to detail and hard work is much appreciated by the town. John Arrigo read from some literature concerning classroom size and adding class space. John A. stated some figures concerning sewer upgrade costs. Arrigo expressed his concern over taking out the tennis courts and would like to see at least one court stay. Arrigo and Pero discussed some figures and options concerning playground equipment and area. Supervisor Pero made a state of the town report stating the financial stabilization of the town, police dept. updates, park improvements, summer fest and concert series (grant), town forum meeting, earned interest, grants: (files in various offices, code book updated and online,) received over $100,000.00 in grants. The town has an unreserved balanced of $241,000.00, the towns expenditures went down while revenues went up with a net positive gain. Pero went on to state the Town Board is ready to move forward on their projects naming Memorial Park, Surfside water extension with a hydrant on OLS Rd, Park expansion, Senior building, new office and storage at town hall, development of Route 5 and 20. The future brings many exciting projects some in conjunction with other communities. (for exact figures and comments contact Supervisor Pero). Town Forum has been rescheduled to April 14 1:00 PM at the Town Hall Driving Insurance Rate Reduction class will be held May 14 & 15 at the Community Building from 6:30 ? 9:30 PM each night Acknowledgement of sign donated by Schritchfield Signs on Brant Farnham Road for the Senior Building. Thank you very much. Judge Gugino represented the Town of Brant as our delegate at the Association of Towns Annual Conference in New York City. Some of the resolutions that were covered this year concerned: amounts for towns of court reimbursement monies, requirements for tax exemptions, town speed limits, requirements for legal notices, and chips monies. Supervisor Pero commended the various Town boards and town employees for all their hard work and having a successful year. Pero had special thanks for Joseph Gardyjan for all his hard work for the Town: he attends many meetings for the Town, brings back useful information to many departments, is an asset to the Town and does all these duties at no cost to the Town. Supervisor Pero mentioned the other areas of Town where the Town Board is looking at development other than the four corners in Brant mentioning; Surfside, Route 5 and 20 development with water and sewer, water on Cain Rd, and appropriate businesses in each area with protection of agriculture and increase housing. Pero stated that the town Code Book is on- line at this time. Pero asked Board members to review the information on recreation to go over at the next workshop. Supervisor Pero acknowledged receipt of Mark Walter?s resignation as Brant?s Disaster Coordinator due to illness. Supervisor Pero acknowledged receipt of letter from John & Betty O?Donnell concerning their support of Wall mart in Evans. Supervisor Pero acknowledged letter from Senator Volker concerning our request for funds for water extension project. Supervisor Pero acknowledged letter from J. Bruno, Tedisco, for receipt of our recent resolution concerning internet sex offenders. Supervisor Pero acknowledged letter from Joel Giambra and Erie County Governments concerning opposition to the tax lien program. Supervisor Pero acknowledged copies of various resolutions? from other towns. Pero reported on: a meeting he had with engineers on the costs of implementation of park expansion,also attended a meeting with South Town coalition, next meeting April 13, February 22nd with Rural transit, and gave information on volunteering for Rural Transit. Supervisor Pero thanked Lee Brunelli for all his work with Rural Transit. Pero went on to a letter from ECMC, a letter concerning recycling, attended a N.E.S.T. meeting on January 11, and that a N.E.S.T. report was filed and sent, attended Erie County Government meeting. Pero reminded all of TLC Health needing local support and their efforts to improve services. Announced a Local Government conference is being held at Houghton College on May 9th. Announced a Local partnership meeting on March 16 with Bob Reynolds. Announced a Hazmat meeting on March 24th. Acknowledged a letter from a Boy Scout concerning a drive for school supplies. Acknowledged receipt of a certified complaint letter from a resident which was turned over to the proper department as the Board has no jurisdiction. Supervisor Pero made a statement to the visitors: ?it was brought to my attention about last month?s apology; it had nothing to do with the budget but everything to do about our meeting place. This is a sacred place, it is where the Town of Brant conducts its business and it demands respect. Some may find it funny or would like to disrespect the privilege of the floor, in which case, they will be asked to leave. No one should be insulted or abused in such a sacred place as our Town meetings. As Supervisor I am responsible to the people of this Town to maintain an atmosphere of respect at all Town meetings and I will not tolerate nonsense and disruption.?
